Welcome to Preslar's Western Shop. These Terms and Conditions ("Terms") govern your use of the website located at www.preslars.com (the "Site"), our brick-and-mortar store at 3299 Fern Valley Rd., Louisville, Kentucky 40213, and any purchases you make from us. By accessing the Site or buying our products, you agree to be bound by these Terms.

1. Who We Are

Preslar's Western Shop has been Louisville's hometown source for western boots, work boots, hats, and apparel since 1958. You can reach us at:

2. Eligibility

To place an order with us you must be at least 18 years old, or have the consent of a parent or legal guardian. By placing an order, you represent that the information you provide is accurate and complete.

3. Products and Pricing

We do our best to describe and price every product accurately. Prices and product availability can change without notice, and we reserve the right to correct any pricing or description errors at any time. Photos and descriptions are intended as a fair representation, but actual colors, sizing, and small details may vary from screen to screen.

If we identify a pricing error after you place an order, we will contact you before charging your payment method. You may either confirm the corrected price or cancel the order at no cost.

4. Orders, Payment, and Acceptance

Submitting an order on the Site is an offer to purchase. We accept your offer when we ship the product or send you an order confirmation email, whichever comes first. We may decline or cancel an order at our discretion, including if the product is out of stock, if there is a suspected error in pricing or description, or if we cannot verify the billing information you provided.

We accept the payment methods listed at checkout. Your payment information is processed by our payment processor; we do not store full card numbers on our servers.

5. Shipping

Shipping terms, carriers, and timing are described on our Shipping Policy page, which is incorporated into these Terms by reference. Title and risk of loss pass to you when the carrier picks up the items.

6. Returns and Exchanges

Our return and exchange policy is described on our Returns & Exchanges page, which is incorporated into these Terms by reference. Please read it before purchasing, as some categories of merchandise (for example final-sale closeouts) may be non-returnable.

7. Trademarks and Brands

Preslar's is an independent, authorized retailer of the brands sold on this Site. All third-party brand names, logos, and trademarks displayed on the Site (including but not limited to Ariat, Justin, Dan Post, Lucchese, Twisted X, Wrangler, Carhartt, Timberland, Roper, Stetson, M&F Western, and others) are the property of their respective owners. Use of those marks on this Site is for product identification only and does not imply endorsement, affiliation, or sponsorship beyond an authorized dealer relationship.

8. Site Content and Intellectual Property

All photography, product descriptions, page text, and layout on this Site that was created by Preslar's Western Shop is owned by Preslar's Western Shop or used under license. You may not copy, reproduce, or distribute Site content for commercial purposes without our written permission. You may share product links and use product photos for non-commercial personal purposes.

9. Warranties

Manufacturer warranties, where they exist, apply to the products we sell. We will pass along any manufacturer warranty information that is included with the product. Beyond any applicable manufacturer warranty, products are sold "AS IS" to the maximum extent permitted by Kentucky law. We do not provide any additional implied warranty of merchantability or fitness for a particular purpose beyond what cannot be disclaimed under applicable law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Preslar's Western Shop will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or from any product purchased through the Site. Our total liability for any claim related to your purchase is limited to the amount you paid for the product giving rise to the claim. This limitation does not apply to liability that cannot be limited under applicable law, including personal injury caused by our negligence.

11. User Conduct

You agree not to use the Site in any way that violates applicable law, infringes the rights of any person or entity, or interferes with the operation of the Site. We may suspend or terminate your access to the Site if we reasonably believe you have violated these Terms.

12. Third-Party Links

The Site may link to third-party websites we don't operate (for example brand pages, social media, or shipping carrier tracking pages). We are not responsible for the content, privacy practices, or terms of those sites.

13. Privacy

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

14. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Jefferson County, Kentucky, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. Your continued use of the Site after a change means you accept the revised Terms.
